REFUND AND RIGHT OF WITHDRAWAL POLICY

PART A – European Union consumers (right of withdrawal)

This Part A applies to clients acting as consumers and resident in the European Union, under the Italian Consumer Code (Legislative Decree 206/2005) and Directive 2011/83/EU.

1. Right of withdrawal. The consumer Client may withdraw from the contract, without giving any reason, within 14 (fourteen) calendar days. The period runs from the day the Client (or a third party other than the carrier) acquires physical possession of the goods; for multiple items delivered separately, from possession of the last item. Under Article 59 of the Consumer Code, withdrawal does not apply to goods made to specification or clearly personalised (e.g. personalised watch straps).

2. How to withdraw. Before the period expires, the Client may: (a) use the “Withdraw from the contract” button on the Website; (b) complete and send the model withdrawal form below; or (c) send any other explicit statement to info@colareb.it stating the intention to withdraw, the products concerned and the order number. Colareb confirms receipt of the request without undue delay on a durable medium (e-mail).

3. Reimbursement. Colareb reimburses all payments received, including the outbound delivery costs (up to the least expensive standard delivery offered), without undue delay and within 14 calendar days of being informed of the withdrawal. Supplementary costs are not reimbursed where the Client chose a delivery other than the least expensive standard one. Reimbursement uses the same means of payment, at no cost to the Client. Colareb may withhold reimbursement until the goods are received back or proof of return is provided.

4. Return of goods. The Client returns the goods within 14 calendar days of communicating withdrawal to: Colareb S.R.L., Via Magenta 5, 00185 Rome, Italy. Direct return costs are borne by the Client. A tracked and insured courier is recommended.

5. Diminished value. The Client is liable only for diminished value resulting from handling beyond what is necessary to establish the nature, characteristics and functioning of the goods (as permitted in a physical store). Where returned goods show diminished value due to use or handling beyond such assessment (e.g. a strap worn or used to the point of being creased, marked or no longer marketable), Colareb may deduct the corresponding amount from the reimbursement, up to the full value of the item.

6. Legal guarantee. Withdrawal is distinct from the 24-month legal guarantee of conformity (Articles 128 et seq. of the Consumer Code), which is unaffected.

PART B – Customers outside the European Union (voluntary return policy)

The EU right of withdrawal does not apply to customers resident outside the European Union. Colareb offers such customers the following voluntary return policy:

A return may be requested within 14 calendar days of delivery by contacting info@colareb.it with the order number.
The strap must not have been worn for any reason and must be returned intact, unused and in its original packaging.
Return shipping costs are borne by the customer.
The refund covers the product price only: outbound shipping costs are not refunded.
The refund is issued to the original means of payment after the item is received and inspected.
Personalised goods are excluded.

Where the mandatory law of the customer's country grants broader rights (e.g. in the United Kingdom), those rights apply.

INFORMATIVA SUI RIMBORSI E SUL DIRITTO DI RECESSO

PARTE A – Consumatori dell'Unione Europea (diritto di recesso)

La presente Parte A si applica ai clienti che agiscono come consumatori e risiedono nell'Unione Europea, ai sensi del Codice del Consumo (D.lgs. 206/2005) e della Direttiva 2011/83/UE.

1. Diritto di recesso. Il Cliente consumatore ha diritto di recedere dal contratto, senza fornire alcuna motivazione, entro 14 (quattordici) giorni di calendario. Il periodo decorre dal giorno in cui il Cliente, o un terzo da lui designato diverso dal vettore, acquisisce il possesso fisico dei beni; in caso di più beni consegnati separatamente, dal giorno in cui acquisisce il possesso dell'ultimo bene. Ai sensi dell'art. 59 del Codice del Consumo, il recesso è escluso per i beni confezionati su misura o chiaramente personalizzati (es. cinturini personalizzati).

2. Come esercitare il recesso. Prima della scadenza del termine, il Cliente può: (a) utilizzare il pulsante «Recedere dal contratto» disponibile sul Sito; (b) compilare e inviare il modulo tipo di recesso in calce; oppure (c) inviare qualsiasi altra dichiarazione esplicita a info@colareb.it, indicando volontà di recesso, prodotti interessati e numero d'ordine. Colareb conferma senza indebito ritardo la ricezione della richiesta su supporto durevole (e-mail).

3. Rimborso. Colareb rimborsa tutti i pagamenti ricevuti, compresi i costi della spedizione di andata (nel limite della spedizione standard meno costosa offerta), senza indebito ritardo e comunque entro 14 giorni di calendario dalla comunicazione di recesso. Non sono rimborsati i costi supplementari se il Cliente ha scelto una consegna diversa dalla standard meno costosa. Il rimborso avviene con lo stesso mezzo di pagamento iniziale, senza costi per il Cliente. Colareb può trattenere il rimborso fino al ricevimento dei beni o alla prova della loro spedizione.

4. Restituzione. Il Cliente restituisce i beni entro 14 giorni di calendario dalla comunicazione di recesso a: Colareb S.R.L., Via Magenta 5, 00185 Roma. I costi diretti di restituzione sono a carico del Cliente. Si raccomanda corriere tracciato e assicurato.

5. Diminuzione di valore. Il Cliente è responsabile della sola diminuzione di valore risultante da una manipolazione diversa da quella necessaria a stabilire natura, caratteristiche e funzionamento dei beni (come sarebbe consentito in un negozio fisico). Se i beni restituiti presentano una diminuzione di valore dovuta a uso o manipolazione eccedenti tale verifica (es. cinturino indossato o utilizzato al punto da risultare piegato, segnato o non più commercializzabile), Colareb può trattenere dal rimborso l'importo corrispondente, fino all'intero valore del bene.

6. Garanzia legale. Il recesso è distinto dalla garanzia legale di conformità di 24 mesi (artt. 128 ss. Codice del Consumo), che resta impregiudicata.

PARTE B – Clienti al di fuori dell'Unione Europea (politica di reso volontaria)

Ai clienti che risiedono al di fuori dell'Unione Europea non si applica il diritto di recesso UE. Colareb offre a tali clienti la seguente politica di reso volontaria:

Il reso può essere richiesto entro 14 giorni di calendario dalla consegna, contattando info@colareb.it con il numero d'ordine.
Il cinturino non deve essere stato indossato per alcun motivo e deve essere restituito integro, non usato, nella confezione originale.
Le spese di spedizione di reso sono a carico del Cliente.
Il rimborso riguarda il solo prezzo del prodotto: le spese di spedizione di andata non sono rimborsate.
Il rimborso è effettuato con lo stesso mezzo di pagamento iniziale, dopo il ricevimento e la verifica del bene.
Sono esclusi i beni personalizzati.

Ove la legge imperativa del paese del consumatore preveda diritti più ampi (ad es. nel Regno Unito), si applicano tali diritti.
